Legal Expert Reveals Trump’s Option In NY Case

Former President Donald Trump could avoid an unprecedented arrest after a prominent legal expert found a loophole around New York Supreme Court Judge Juan Merchan’s order.

Trump Began the defense of his hush money case on Monday. On the first day of the trial, the judge threatened to arrest the former president if he missed any trial day. The judge also declined to grant Trump’s request to miss a court appearance on May 17 to attend his son Baron’s graduation.

Former Harvard law professor and prominent defense attorney Alan Dershowitz told Fox Business on Monday that the judge’s threat was a form of election interference. Dershowitz urged Trump’s attorney to file a “mandamus right” to avoid the judge’s order.

“I would hope Trump’s lawyers bring a mandamus right now, at the very least, let Trump out of the courtroom, let him campaign,” Dershowitz told host Larry Kudlow. “If he makes a decision that he would like to waive the right to be there, there is nothing in the Constitution which gives the prosecution the right to keep him there. It is only a defendant’s right. If the defendant chooses to leave the court, whether to go to his son’s graduation from school which apparently the judge didn’t grant or campaign in Pennsylvania, he has the right to do that. That is a constitutional case that should be brought immediately.”

Fox News Legal analyst Greg Jarret agreed with Dershowitz adding that he is skeptical of the former president getting a fair trial.

“The judge today ordered Donald Trump to be there everyday or he was going to toss Trump in jail,” Jarret said. “The professor is absolutely right. This is election interference. They want to take him off the campaign trail for the next two months to benefit Joe Biden and damage Donald Trump. I think they are underestimating the intelligence of the American voters. They see this for what it is. Dirty legal tricks, lawfare in order to interfere with an election.”

Fox Nation host Piers Morgan on Monday urged Trump to defy the judge and attend his son’s graduation.

“Donald Trump should go to his son’s graduation … go to the graduation. Honestly, if you’re watching, President Trump, just go to the graduation. Every parent in America, whether they like you or hate you, will go, ‘Yeah, I’d have done that, too,’” Morgan said after describing the case as the “most pathetic and self-harming act of political suicide ever witnessed.”
