Law Professor Blast ‘Tyrant’ Trump Judge

Daily Report May 22,2024

Judge Juan Merchan’s handling of former President Donald Trump’s hush money case continues to come under heavy scrutiny, with former Havard law professor Alan Dershowitz labeling him a tyrant.

In a Daily Caller column, Dershowitz wrote that he was shocked by what he saw in Court on Monday.

“The judge in Donald Trump’s trial was an absolute tyrant, though he appeared to the jury to be a benevolent despot. He seemed automatically to be ruling against the defendant at every turn,” Dershowitz wrote. “Many experienced lawyers raised their eyebrows when the judge excluded obviously relevant evidence when offered by the defense while including irrelevant evidence offered by the prosecution.”

The law professor also spoke of surprise when Merchan got angry and threatened to strike Robert Costello’s testimony for raising an eyebrow at him.

“When the defense’s only substantive witness, the experienced attorney Robert Costello, raised his eyebrows at one of New York Supreme Court Justice Juan Merchan’s rulings, the court went berserk,” Dershowitz continued. “Losing his cool and showing his thin skin, the judge cleared the courtroom of everyone, including the media. For some reason, I was allowed to stay, and I observed one of the most remarkable wrong-headed biases I have ever seen. The judge actually threatened to strike all of Costello’s testimony if he raised his eyebrows again.”

Dershowitz maintained that Merchan’s testimony would have threat was “absolutely outrageous, unethical, unlawful and petty.” The law professor insisted that the judge’s threat revealed his utter contempt for Trump and anyone who offers to testify in his favor.

John Yoo, a former DOJ official under the Bush administration, criticized Merchan on Monday over his decision to limit former Federal Election Commission (FEC) commissioner Brad Smith’s testimony.

“It’s weird to me actually to see Judge Merchan letting Stormy Daniels testify at will all over the place on things that are not actually relevant to the trial and then he’s all over Brad Smith,” Yoo said. “He is Not just a worker. Brad Smith is a distinguished constitutional law expert. He’s actually one of the top scholars on the federal election law. He’s one of the first people who identified all the problems with the federal election law. This is the perfect guy actually. I would think if a judge would be deferential and let someone testify at length, it should be Brad Smith, not Stormy Daniels.”
